In a truly disconcerting decision, the Texas Supreme Court ruled this week that while same-sex couples are allowed to be married, they may not necessarily be granted the rights that married different-sex couples have.
A lower court had ruled that Houston must extend health and life insurance benefits to the same-sex spouses of city employees, the same way it offers these benefits to different-sex married couples.
But the state Supreme Court reversed that ruling. While there will be no immediate consequences for LGBTQ city employees in Houston, the ruling suggests that same-sex couples in Texas might be married in name only.
In its ruling Friday, the Texas high court acknowledged that the U.S. Supreme Court legalized gay marriage nationwide two years ago in Obergefell vs. Hodges, but added that it is unclear what other rights the decision extends to same-sex couples. That must be hashed out in the courts in cases like this one, it said.
What happens next is largely up to Houston. City officials could appeal the decision directly to the U.S. Supreme Court or could choose to head back to trial. They did not comment Friday on what path the city would take, saying they are considering their legal options.
“The City of Houston will continue to be an inclusive city that respects the legal marriages of all employees,” Mayor Sylvester Turner said. “Marriage equality is the law of the land, and everyone is entitled to the full benefits of marriage, regardless of the gender of their spouse.”
Marriage equality is about more than a piece of paper, and LGBTQ equality is about more than marriage. Texas, this is disappointing on so many levels – and we’ll see if it merits a trip to SCOTUS.

April 27th update: All 13 South Korean LGBT activists have been released from police but the fight continues. Homophobic comments are rampant in nearly all of the news articles, many are blaming these activists for protesting ‘unlawfully’, and there are even false news circulating that these activists were violent.
The reason why these activists went after Jae-In Moon, presidential candidate of Liberal Party, was because 1) he is the presidential candidate with the most amount of support, 2) he is a former human rights lawyer so his statement that he ‘opposes homosexuality’ was very disappointing, and 3) all other candidates are publicly saying that they will ‘ban homosexuality’. The only candidate who has stated full support for marginalized group, including LGBT people, is Sang-Jung Sim of Justice Party.
