It’s too bad trans girls are in so much danger from police and social violence because otherwise they’d be the perfect group to push the envelope on “Free the Nipple”.
Unless they get their gender markers changed they’re legally allowed to be topless in public.

Numerous trans women over the years, with or without their legal markers changed, have been arrested for public indency for toplessness, in states where men can be topless, before being charged and jailed with men.
The state has absolutely no problem using unfair double standards to punish trans women just for existing.
Ok so first off if it is a trans woman as in a man who has transitioned to a woman then being arrested for exposing her breasts is not unfair in any way against trans women as the officer could not nor any one involved be able to just tell on sight if they have gotten it changed over in the books and in this situation as is with most it is not even about what is in the book but what is visually perceived for the same reason that if I walked around with a picture of feminine breast but told people don’t worry these are a guy’s breasts I would still be arrested.
You’re missing the point. The letter of the law states that trans women are “men” until we get our gender markers changed while men are often exempt from laws against toplessness, even if they have fat deposits on their chest.
The state refuses to treat a trans woman as a woman, until it can be used to harm and criminalize them. Arrested for public indecency as a woman, jailed and imprisoned as a man.
It’s a double standard.
